條款及細則
1. 本一般條款及細則適用於您的購買; 請登入我們的網站了解更多關於您購買療程和/或產品在發票上所列出的具體條款及细則。
These are standard terms and conditions of your purchase; please visit our website for the specific terms and conditions applicable to your treatment program(s) and/or products as printed on the invoice.
2. 若對該購買的療程/產品之種類/數量有任何爭議或差異,一律以發票所列為準。
If there are any disputes or discrepancies on the type/quantity of the treatment services/product, the terms and conditions of this official invoice shall prevail.
3. 為保障顧客權益,若顧客從未使用已購買療程,可於購買療程(不包括任何Metaganics產品、Cell Armour、體質測試、Inbody 健康分析、營養師諮詢)後24小時內(由發票的發出日期和時間起計算)提供合理原因申請退款,逾時將不獲受理。顧客必須親身致電客戶服務熱線:(852) 2972 0390 或電郵:cs@neoderm.com.hk 去辦理該退款申請。本公司將收取退款療程款項的9% 作行政費用。
To protect the interest of the customer, the customer, before commencing any treatment (excluded any Metaganic’s product, Cell Armour, Test, InBody Health check, Nutritionist Consultation), may request with reasons a refund within 24 hours from the time and date that printed on the official invoice, no late application shall be accepted. The customer must call in person the Customer Services Hotline:(852) 2972 0390 or email: cs@neoderm.com.hk to cancel the purchased treatment. A sum equivalent to 9% of the total sum of the purchased treatment will be charged as our administration fees.
4. 為免產生爭議,本公司不會提供任何未列於正式發票所載的療程及/或產品。為保障顧客利益,顧客請勿與本公司任何職員達成任何口頭承諾或私下安排享用療程及/或產品。任何在購買療程所產生的條款差異必須由董事總經理以書面形式簽字確實。
For the avoidance of doubt, under no circumstance shall our Company provide any treatment and/or product which is/are not included in your purchased treatment as printed in the official invoice. Any purported commitment or private arrangement with any staff of our Company in respect of using the treatment and/or product shall be invalid and unenforceable. Any variation of the terms and conditions of any purchased treatment must be in writing and signed by the managing director.
5. 所有療程 (付費體驗療程除外) 有效期均為六個月(由購買日期起計算) 或於發票所列印的到期日前有效。任何付費體驗療程有效期均為2個月 (由購買日期起計算)。所有購買的療程只能由一個顧客使用,不可轉讓也不能與其他顧客分享。
All treatment courses (except for paid trial) are valid for six months or on/before the expiry date as specified and printed in this Invoice. Any paid trial treatment courses are valid for 2 months (from date of purchase). The purchased treatment can only be used by one customer and is not transferable and cannot be split between customers.
6. 顧客如欲更改或取消已預約之療程,請最少於療程12小時前聯絡本中心。如顧客不出席所預約之療程,本公司將會於顧客療程紀錄扣除該次
療程。顧客可通過以下方式聯絡本中心:

6.3 療程中心;或
6.4 gratus手機應用程式。
Customer shall notify our center (“our Center”) 12 hours in advance to change or cancel the booking of treatment. If the customer does not show up on the reserved treatment time, such reserved treatment will be considered as used and will be deducted from the customer’s record accordingly. The customer can contact our Center as follows: -

6.3 Treatment Centre; or
6.4 gratus Mobile Application
7. 若顧客未能按指定時間到達療程中心可能會引致療程時間縮短,本公司或許會為顧客重新安排預約時間。
Late arrival may result in reduced treatment time or we may have to reschedule your appointment.
8. 本公司恕未能承諾每次療程都交由同一治療師服務顧客。如曾經或已經安排給顧客的治療師因任何原因而變動,本公司毋須另作通知,但本公司會盡力減少此變動情況。
Our Company cannot guarantee to arrange the same therapist to do the entire treatment for the customer. Due to unforeseen circumstances, the company would, at its sole discretion, change the therapist for the customer without any further notice to that customer. However, our Company will try our best endeavours to minimise such circumstance might happen to the customer.
9. 本公司只會確認顧客於本中心或gratus手機應用程式上預約的療程日子及時間。有關的預約日期和時間,取決於本中心的可提供時段以及該購買療程的種類。若本公司未能提供上述的療程日子及時間予顧客選擇,本公司會安排另一個可提供的時間給顧客享用療程。
Our Company will only be able to confirm the date and time of the booking for treatment(s) which are made either by the customer at our Center or through gratus mobile application. The relevant date and time of the booking are subject to the available time slot of our Center and any restrictions may be imposed on the types of purchased treatment. The customer acknowledges that the booking for the purchased treatment may not be available at all times on all days and if the customer’s chosen date and time are not available, our Company will arrange another available time slot for the treatment.
10. 顧客於簽署此發票及付療程費用時,表示已接受及全部明白此一般條款及細則及其購買療程種類的相關條款及資料。
By signing the invoice and making payment of the purchased treatment, the customer accepts these standard terms and conditions and the relevant specific terms and conditions applicable to the type of the purchased treatment in full.
11. 顧客理解療程反應因人而異,療程存在一定固有的潛在風險,因此顧客必須在使用療程服務之前簽署療程同意書,確認她/他對各種潛在風險的理解。
The customer acknowledges that different persons respond to the treatment differently and there is always an inherent potential risk associated with the treatment, therefore it is imperative that the customer must sign the treatment consent form before utilizing the purchased treatment services to acknowledge his/her understanding of such potential risks and his/her consent to such treatment.
12. 顧客如因皮膚/健康狀況不適合繼續進行已購買的療程,可向本公司提供註冊皮膚科或相關醫生之有效證明書正本,申請轉換療程或退款。本公司就有關申請保留最終決定權。退款以當時的療程原價計算,扣除所有贈送或試用療程及/或產品的價值後,該淨值將再扣除9%行政費用。
If the customer is not suitable to continue the purchased treatment due to skin/health conditions, the customer may request to swap the treatments or refund by producing a valid original certificate of diagnosis issued by a qualified dermatologist or related doctor. Our Company shall have the final say on the request. The refundable amount will be calculated at original price at the time of purchase after deducting the corresponding value of complementary or trial treatment/product and the net refundable amount due to the customer shall be subject to further deduction of our administration fee in a sum equivalent to 9% of the net refundable amount.
13. 除條款3及條款12外,所有醫學美容療程費用不設退款。購買療程時所送贈之免費療程,必須在完成單據內之付費療程後才可進行。免費療程沒有商業價值,不得算作顧客購買的療程的一部分。如因個別情況需要退款、轉換品牌或重組療程,所有購買療程時所送贈之免費療程及優惠均會被取消。
Subject to the above clauses 3 and 12, payment for treatment courses is nonrefundable. The customer may only start the free treatments after the completion of all the treatments for the treatment course subscribed by the customer. The free treatments are of no commercial value, and they shall not be counted as part of the treatment course subscribed by the customers; the free treatments shall be forfeited forthwith if the customer fails to complete all the treatments of her/his subscribed treatment course. Our Company may allow a customer’s request for any swap of the treatment course, but no credit for any free treatment nor any discount of the previous treatment course shall be applied nor brought forward to another treatment course the time of the swap.
14. 退換貨品必須連同單據正本於購買後7日內進行,每件貨品只可退換一次 (不設退款),逾時退換將不獲受理。已使用、損毀、減價、免費或與本公司物流紀錄不符的貨品,一律不設退換。本公司有權檢查貨品是否已用或已損毀。
An exchange of product(s) would be accepted only upon presentation of the original official receipt within seven days from the date of purchase. Each product can only be exchanged once (no refund will be allowed), late request for exchange shall not be accepted. Any used, damaged, discounted, complimentary product or the returned product which is not matched to the records of our logistic department cannot be exchanged. Our Company has the absolute right to examine and determine if the product(s) have been used or damaged.
15. 顧客只會按照其個人需要選購療程及/或產品,本公司並不會強迫顧客購買任何療程及/或產品。
Customer shall only purchase the treatment and/or product according to his/her own requirements; it is our Company’s policy not to compel any customer to purchase any treatment and/or product.
16. 顧客明白療程反應因人而異,並且明白所購買的療程和/或產品的效果,會因應顧客的身體和健康狀況而有所不同。顧客在自願的情況下接受並同意購買療程/產品,並且願意承擔風險。因顧客在治療前已得知預期效果,本公司不會就顧客購買的療程及/或產品的預期效果作任何陳述、保證或擔保。在任何情況下,顧客都不能以療程和/或產品的效果未如預期,提出索賠或要求退款。
The customer acknowledges that different persons respond differently to the purchased treatment and that the outcome of the purchased treatment and/or product is always subject to the customer’s own body conditions and health. The customer accepts and consents to the purchased treatment/product voluntarily at his/her own free will and at his/her own risk. Our Company makes no representations or warranties or guarantees that the purchased treatment and/or product will produce the desired effect as the customer might have perceived before treatment. Under no circumstances shall the customer make any claim on the ground that the purchased treatment and/or product fail to achieve the customer’s expectation; much less asking for a refund.
17. 顧客如有任何疾病、過敏反應或皮膚狀況問題,請於購買療程前及每次享用療程前,如實向本公司職員申報,以便本公司為顧客作出適當安排。如有任何疑問,顧客應聯絡醫生查詢。因疾病或過敏反應而引致的或相關的任何意外或損傷,本公司將不會負責。
The customer should forthwith notify our staff of any of his/her sickness or allergies or skin conditions before purchasing the treatment and every time utilising the treatment, so as to enable our Company to make a suitable arrangement. The customer should consult his/her doctor in any event of any doubt. Our Company shall not be held liable for any side effect or accident or injury suffered by the customer associated with the customer’s diseases or allergies (of whatever causes or origins).
18. 顧客如使用信用卡分期付款計劃,請於確認交易或付款前向相關銀行查詢所有與付款計劃有關的事宜(包括但不限於有關利息計算方法或任何手續費等)。任何該等事宜上的責任,本公司概不負責。
If a customer makes payment under a credit card instalment plan, the customer shall consult the relevant bank on all the matters relevant to such instalment plan (including but not limited to the related interest calculation method or any charges etc.) before confirming the transaction or making any payment. Our Company shall not be responsible for any such matters.
19. 顧客繳付之訂金必須於繳付日起2個月內使用於購買療程及/或產品,逾期作廢。訂金不設退款。
Customer must use the deposit to purchase the treatment and/or product within two months from the date of the payment of the deposit, and such deposit shall be forfeited thereafter. The said deposit is non-refundable.
20. 本公司在療程前有可能要求顧客出示身份証明文件以核對身份。
Before treatment, the customer may be requested to provide his/her identity proof document for verification.
21. 顧客若要求轉換付款方式,如轉用分期、其他信用卡或更改分期期數,顧客必須於付款日起計3個工作天內,親臨本中心申請並先以新付款方式付款。
If customer requests to change the payment method, such as payment by instalment, using other credit card or changing the period of instalment, the customer must come to our Center in person within three working days from the date of payment to apply for such change and make payment by the new payment method.
22. 顧客如需要將名下所有品牌療程轉到香港以外之其他分店,必須親臨本中心提出書面申請,並須繳付該購買之療程款項的6%作行政費用。顧客只可以一次性的轉移其名下的所有療程,並且不能轉回香港。
If customer requests to transfer all his/her remaining treatment(s) under all our brands to our overseas Center, the customer shall provide the company with a written application in person at our Center and pay our administration fee in a sum equivalent to 6% of the value of the relevant purchased treatment(s). The customer is entitled to transfer the treatment(s) under his/her name on a one-off basis; such treatment transfer shall not be reverted to the Centres in Hong Kong.
23. 我們重視顧客私隱,只有得到授權的人才獲准查閱您的個人資料。顧客的個人資料將用於處理訴求/查詢;提供療程;進行與您的療程相關的巿場調查;以及通知您有關新的療程或產品推出。有關我們處理個人資料政策,請參閱我們的網站。
Your privacy is important to us and only authorised persons may have access to your personal data. Your personal data may be used for the purposes of dealing with your request/enquiries; for the provision of treatment; conducting market research survey associated with your treatment or otherwise and providing you with information about any new treatments or product news offered by us. 24. 如本公司未有或延遲行使任何權利、權力或補救,也並不代表本公司自動放棄。
No failure or delay by the company in exercising any right, power or remedy hereunder shall operate as a waiver thereof.
25. 本公司保留隨時修改條款及細則的權利,無須另行通知。如有任何爭議,本公司保留最終決定權。條款及細則的中英文版本如有歧義,概以英文版本為準。
Our Company reserves the rights to amend the terms and conditions at any time without further notice. In case of any disputes, our Company reserves the rights to make the final decisions. If there is any inconsistency between the English and Chinese versions of terms and conditions, the English version shall prevail.
26. 本條款及細則受中華人民共和國香港特別行政區的法律管轄。
The governing law of these terms and conditions shall be the laws of Hong Kong Special Administrative Region of the People’s Republic of China.
